Closed Acc

Looking for some Advise...

I opened a paddy power Acc with all my correct details but used my Partner card with her permission I made several deposits and also 2 seperate small withdrawals no issues I then won £6000 withdrawn the funds and paddy power have now closed the acc and said you are not allowed to use my Partner card and will not be receiving my winings I completely understand i should of read all T&Cs But my compliant is surely the small withdrawals should of also failed Why can the just pick choose when to enforce The T&Cs depending on the amount you are trying to withdraw

Hi and welcome to the forum.

I've just checked their terms and conditions and can't find anything under 7. Deposits & Withdrawals that directly applies to deposits from a third party card. But I can tell you there are not many casinos that allow it. I assume verification had not taken place on the previous two smaller withdrawals? Did the money go back to your partners card or an adiditional payment method?

No verification had not happend before I withdrew the two smaller amounts and the funds went back on to the card that i used when registered witch is my partners card and where the multiple deposits came from the My partners card is registered at the same address

You’ll have hit the enhanced due diligence checks of 2k plus. 

Some casinos, v v low number, might allow you to deposit using a different name if you can show they’ve permitted you to. But most wont.

Same as some sites online: cardholder name must match account name or payment is refused but the majority of sites, not just casinos, allow them to be different.

If you take this to an ADR they’ll likely rule in favour of the casino.

Curiosity; why use a card not in your name?

I had lost mine and joined and the deposit bonus you received on joining expired after 48 your.. To be honest it might sound daft didnt real put much thought into it.. I deposited mutiple times probably around 7 times no issues also withdrew twice the money went into my partners account instantly it just when it was the 6000 the account was closed.. My issue is that your not allowed to do it surely the acc should of closed when the smaller amounts was withdrawn... If feels like they can just inforce due to the amount seems unfair

Said before that I don’t know what’s the barriers to matching account holder on the site to the payment method and throwing a flag up when they don’t match via the payment processor...some do it; I went to pay something years ago using my Gfs card and it said ‘names must match’ so it can be done....

There is an argument along the lines of your take the bet, you must pay or any failings on controls are on the casino so to speak.

One again that would be interested to see tested in court

Additionally, it’s not just a breaking of the ta and CS of the casino but also your partners bank

Truth be told this is a pretty clear cut t and c so the best you could probably hope for is your deposits back. At best. Can’t see any complaint service or ADR ruling in your favour

They don’t ask for payment methods before that threshold because, simply, they don’t have to

My view on casinos and payments is, and generally speaking, if a casino takes your deposit or bet then, barring you being engaged in lying or misleading ( or the casino not being able to do anything) etc they should either pay out or, at least refund you the cash.

Played a restricted game? You let me bet on it; your fault you never implemented any controls to stop me going into it(we all know casinos can stop this being an issue and the only reason it is is because it serves them better)

I don’t know enough about matching accounts to card names to say for certainty about your example.

Hey there @Adieyates5 and welcome to AskGamblers Forum. 

Hmm, have just took a quick look across PP terms and to my greatest surprise, couldn't find the typical 'you're not allowed to use a payment method which is not registered under your name' etc... 🤔

Still and FYI, the common scenario with online operators is that using  a payment method such as credit/debit card which is not registered under your name is strictly forbidden UNLESS we talk about a joint bank account. 

More details will be appreciated on order to get an adequate and correct further advice.

I have done that and received a reply saying that my partner card needs to be removed and my own card added they have processed a refund of the deposit to my partner card once card removed my account will be reactivated

So does this mean i will be able to withdraw the remaining funds in my paddy account with is now 5900 to my own card

Sounds to me like they are just refunding the deposit and the rest will be forfeited. Is the balance still showing in the account?
