BitStarz Confiscated 4.5BTC

I signed up for BitStarz for the first time ever on Feb 13 2020
Of course I didn't read any rules, who does anyway??
It asked me for my personal details soon as I signed up.
I put my REAL NAME, REAL STREET ADDRESS, REAL CITY, REAL STATE.The country however, it would NOT allow me to choose USA.
So i literally just clicked anything, which was RU. 

Made my FIRST deposit of .085 btc ($850 US Dollars)
clicked on GIVE ME BONUS by MISTAKE. (ill get back to this later)
Then i opened my VPN and put it on Ukraine
Opened up LIVE CASINO,found an AWESOME LIVE baccarat table , sat down SUCCESSFULLY .
Played a man, and WON like a man.
I was able to make 2.8 BTC
I tried to cash out, and was deeply disappointed because of the bonus rules.
No big deal, i spoke with live chat, and they explained what had to be done.
I had to give 3.2BTC worth of action on the slot machines by wagering a MAX of 1mBTC at a time.
So basically i had to spin the wheel 3,200 times, even though my balance was only 2,800 mBTCWhatever total scam..., 
Some strange way i actually managed to 100% complete the bonus rules.
I was left with only 2,080 mBTC (2.08 BTC)
I tried to withdraw, and it was sent to me within 33 minutes!

Feb 15 2020 -
I wanted to deposit more, but this time play a little bit more seriously.
I went to LIVE CHAT, and i asked someone if using VPN was allowed on BitStarz.
I was told 100% it is allowed .. "but we do not encourage it", when i asked why? is it because of risk of losing internet connection? he said "no it's because you may run into future problems", then the chat ENDED. 
I thought that was a bit rude, how he ended the live chat like that..But whatever I thought everything was fine.
He did answer my question..

i deposited .5 BTC ($5,000 US Dollars) (This is my 2nd deposit)
I found a PRIVATE baccarat table HIGH roller.
It would NOT allow me sit down and play, 
i had to have a minimum balance of 700 mBTC  in order to SIT DOWN. 
So i re-deposited again .20 BTC ($2,000 US Dollars). (this is my 3rd deposit) 
I sat down on that same table, and played very well.
I ended up winning 4.5BTC.
I tried to withdraw, nothing came. 
i was told they were waiting on the game provider to provide details to make sure everything was 100% legit.
Its fine, i like that .. i got nothing to hide.I let it go and continued to be patient  

Feb 16, 2020-
Still no withdraw, a little paranoid now,I started actually doing some research on the website for the FIRST time ever now.. and WOW did i get paranoid... ALOT of bad reviews , ALOT of horror stories, and most of all the worst thing i could ever read.
Says NO USA PLAYERS.. LOL... First time I ever seen a BTC casino in my life say that..
I decided what the *****, maybe they will cut me a break i dont know?
I mean every single table allowed me to sit and play, and every single slot machine allowed me to play as well.
It was not obvious what so ever that USA players are not allowed to play here.
The actually domain name is bitstarz.COM..... meaning a USA domain location.
This is completely false advertisement also


Feb 16 2020-
I deposited again .25 BTC ($2,500 US Dollars)  (This is my 4th deposit)
I ended up winning roughly 1BTC
tried to cash out, and was successful on Feb 17 2020 I got the withdraw. 
So that's two different successful withdraws within 4 days.

The 4.5BTC hasn't been successful yet .
I got an email asking for all of my documents
I sent over everything. 
I already knew USA players are not allowed to play,
However what do you expect me to do? send over FAKE documents??
NO, of course not! So i sent over my USA Driver's licence, USA Passport, USA Bank Statement, USA Electricity bill .


Live chat started acting REALLY funny after i sent over my paperwork.
They tried so hard to entrap me by pretending to be friendly and telling me everything is ok, you should be fine,
(OlleBitStarz seems extremely experienced doing this btw)
kept asking for more and more information, selfie of myself outside my house etc.
OlleBitStarz and other live chat members were trying to make me say some things to negatively effect my case, so they can have it on record of course and compare everything to their terms and conditions..


Anyway, everyone can guess what happened after I got wheeled in by OlleBitStarz and the rest of the live chat people.
I felt cornered, so i had to come clean and explain myself,, i said that VPN is a VPN,, not much to discuss here..I asked if VPN was allowed and I was told YES. Obviously I am from the US, i sent over US documents...  I wasn't worried at all,
If you guys really don;t want US players, then how about spending some money on preventing it from happening in the first place?
I was able to play, could be EASILY lost ALL of my money multiple times..
But guess what? I didn't lose , i WON, and you confiscate my money?


Here comes the robot / lawyer email from BlitStarz..


"Hey,
I am writing to inform you that you have failed our verification process and as a result your account has been closed and remaining balance has been confiscated in line with our terms and conditions of use:

3.3 - "... It is your sole responsibility to ensure that the information you provide is true, complete and correct."

You have signed up using a fake address in Russia when you are in the United States. When we realised this and confronted you, it was claimed that you were American but living in Ukraine (not Russia as the profile suggested).

In order to further clarify this we asked for extra documentations, selfies and selfies in the street these further proved to us that you had signed up using incorrect details since you were unable to prove your address or that you were actually in Ukraine and/or Russia. In addition the proof you uploaded of a hotel room being booked was for a single night after you had already won the funds and you later confirmed with your selfie in the streets of the USA that you were nowhere near Ukraine.

Due to breaching our terms and more lying to us about the reasons for the discrepancies your account is closed and the remaining balance was confiscated.

This decision is final from our side.

So basically i got my account CLOSED, and $45,000 US dollars stolen from me, because I LIED TO A LIVE CHAT REP?
Grow up will you?  That's my personal money in there.
I deposited .700 BTC to make 4.5BTC
So you just going to 100% AIR-BET me??
What does it matter where I am from? Obviously I am american i sent over my documents..

My case is solid and their rules state this:
"Bitstarz.com reserves the right to refuse to register an Account or close Your Account. However all virtual funds within Your Account will be returned and all contractual obligations already made honoured."


My virtual funds have NOT been returned to me.
I had a balance of 4.5 BTC in my account.
I did not give a fake address, I put my REAL information, just the country was changed because there was no option for US.
I found out AFTER i won what their dumb rules were about no US players
What does it matter where I am from?
I played with real money, and that is MY money they have. 
The tables allowed me to sit and play, I was able to make withdrawals, and deposits.
You cannot confiscate a player's money. Nowhere does it say they are aloud to do this.
Money must be returned to me, it is MY property..
If you don't accept US players, thats fine kick me off your lame platform,, and if there is an active balance,
WHICH WAS MADE 100% LEGITIMATELY, then that balance SHOULD be returned back to me.

Hi and welcome to the forum. Brace yourself because you're not going to like what I am about to say but I will just state facts rather than opinion. 

1. BitStarz do not accept players from the USA even when playing in bitcoins

2. The reason you could not select USA from the list of countries when you registered is because they do not accept players from the USA

3. You should never have entered Russia as your country of residence - this is asking for trouble regardless of what casino you are in

4. In answer to your questions "why does it matter what country you are from" - Is because there are laws in place and the casino has to follow these laws to keep their license

Now a question - So they've said the will return your deposits have they?  And are you saying you haven't received that ?

The confiscated my balance which was 4.5BTC

And closed my account.

They told me they are ready to fight any case I bring up, and they will not send any money to me what so ever.

Hi guys,

Here to give our side of the story.

So, Ronnie signed up picking Russia as country in his profile and as part of the standard KYC procedure
we asked for documents, upon Ronnie says that he is American, but lives in Ukraine.

No worries there as far as we're concerned, as we do accept Ukrainian residents, and the US docs would
be ok if he's not playing from the US. As proof of address, he didn't have one and provided a copy of a hotel
bill that was from Ukraine and said (this is 20 minutes away from my house).

Upon we said, alright, then please upload a selfie of you outside of your house in Ukraine so we can see that
you are there, upon the player confessed not to be in Ukraine, but actually in the US. I asked the player as to
why he would lie about such a thing, upon he said "I'm superstitious", which is not a very credible answer.

All in all the player actually manage to get 2 BTC profit which is more than just getting the deposits back,
so if you wanted us to go back to square one, you maybe want to return the 2 BTC. We're of course. not
going to ask for that, but you came out on top with a 18,000 dollar profit here.

I think you're missing some important points here.

First of all, there's a big difference in us denying a player the opportunity to play at BitStarz at our own discretion, and us
closing a player's account for breaking the rules of the casino. Also, your quotes about our terms are completely invalid
as we have a rule stating that players from the US are not allowed, which means that if you decide to play despite
us stating this, you cannot call on the rules for legal players. 

Now, you can claim ignorance of the fact that you didn't know until after the fact that you couldn't play from the US, despite
not being able to select US as country and also claiming to have read all my posts in the forum here where I stated this just
a few days ago to clarify.

You not only entered Russia as country in your profile but when confronted about this, you confirmed that you were in the Ukraine,
and not in the US, until we requested a KYC, so you were, in other words, sticking to your lie for as long as you could.

As much as I sympathize with someone winning 4.5 BTC and not getting it, you were not allowed to play at BitStarz in the first place
but broke the rules and did so anyway. You made an 18,000 dollar profit from this, and I find it quite greedy to come and look for further
money when you've been paid half a year's salary in profit and deliberately broke the rules.

Excellent question, we get this now and then :)

So first of all, I don't think Geo block is the greatest of defences, then again, we have players from for example Russia
who do have to use a VPN to get passed their government block. They prefer using free VPN where US is often the only
or first option. This is of course not only for Russia, but just to take that as a concrete example.

why did your system allow him to cash out that 18K profit without first checking his location if he is allowed to play there? how many others have gotten around this and perhaps there is a ceiling before the system gets flagged as in his case the 4.5BTC was over the limit so then you started your checks.

Also why do you block some countries in the EU from playing? yet you ok with players from Russia? You think Putin is ok with that? he could get his KGB after you if he wanted to. j/k . Poland is not on the list of restricted countries yet they are in the EU and they have strict anti online gambling policies. What about Japan or Arab countries. And can someone tell me why askgamblers website setup is basically identical to bitstarz?

I get the same email template from askgamblers as I do with bitstarz.

Also askgamblers live chat and automatic 🤖 responses are very similar to bitstarz live chat..

They also speak the same exact way on live chat and email. Both use the same exact grammar🤔

How is Bitstarz's site identical to AG's? Because there's a bit of white and black?

You expect each live chat across various sites and operators to be wholly distinct - I could line up 20 chat transcripts across 20, OR just the one, casino and i doubt you'd be able to differentiate.

I can assure you we are in no way related to BitStarz, you’re just trying to find fault. 

I will tag @ValDes to help you further with the complaint but I’m not sure you even have grounds for complaint since you’re in clear breach of the terms and conditions. However, Valdes can clarify this better than me. Please be patient and await his reply and be mindful of the forum rules in your future replies.

It was actually a mistake by one of our new support agents, but I cannot blame anyone but ourselves for letting that slip and we'll take the fall for it.

So as to the restricted countries, I cannot speak to the highest level of certainty as to which countries should be restricted, but I'm simply following
Softswiss/Direx directive as to what countries should be and enforce that accordingly. As to Russia, I'm sure Putin isn't super happy about that one,
but there are plenty of grey-zone countries that more established and publicly traded companies still operate on, such as in Japan.

Broader note i think the distinction between countries and their regulatory systems, or lack thereof, is important.

Offering to UK when no licence is a no no for me - primarily because, for all it's faults, they have a system for offering services. Sign up, commit to a certain (albeit overly harsh )level of standard and you're good to go. 

Australia and the USA are just examples of Big Govt restricting folks' choice - particularly Australia.

On that basis i'd rather see 'good' casino's offering services to the last 2 than some charlatans. So i'm always a bit meh when someone says i'm from Aussie and can play here - be glad it's not a Gametech casino etc.

Hey there, 

You case has been rejected simply because there are clear indications for violation of one or more of the operator's terms and conditions. Should you believe the term/s is not fair OR have not been applied in a fair way, you have been clearly advised to escalate the matter in front of the relevant regulatory body. 

The rest of your... hmm, statements, do not even deserve being commented.

How exactly do you expect us to help you? You are in breach of their terms and conditions! The rep has already admitted fault on the casino for allowing the first withdrawal, their bad! Just because of that they’re not going to let you carry on breaking the rules. I honestly don’t know what you expect AG to do to help you here? 
And If I’m being frankly honest, I agree with the rep that you should now be happy with the 18K profit and leave it there. 
Would I be gutted if this was me? Absolutely! But sometimes you have to accept when you’re wrong and you are in the wrong for not reading the terms and conditions which you stated you didn’t do at the very start of this topic.  
If u had read the rules you wouldn’t even have the 18k profit because you would never have played.

Once I won big, they figured out ways to not pay,

it was confiscated nowhere and their rules say they can they're allowed to confiscate my money.

And I come here for help, and all I get is I have no case? Really?

@RhdjeezyOkay, it's just absurd that you selected "Russia" as your country, used "Ukranian" VPN and still managed to withdraw. Did they not ask you to go through KYC?
Just funny that they can "confiscate" your winnings if you are from the US. Meanwhile, nothing happens to them letting someone who is from the US  deposit multiple times on their casino and withdraw too. Glad that you managed to be in the profit as you deposited your own money and gambled, don't care that you were forbidden to do so tbh, they should do a better job at keeping USA players away.

About your withdraw of 4.5BTC, it's just not gonna happen.

Standard for a casino to do extra checks on a withdrawal so big. Nothing new there. 
Should the casino have picked up on your country before hand? Absolutely, you should not have been able to make one let alone two withdrawals. Should they honour this withdrawal? In my opinion NO. 
Bottom line is, you lied in order to play. Sorry I know that’s not what you want to hear, Id love to see you get your winnings I really would, it’s not that I’m siding with the casino but you blatantly and even admittedly broke their terms, how can you honestly expect them to pay you? 😏 
 

And I do agree with the comment above, Hopefully the agent at the casino Olle mentioned will now learn from their mistake as well as you!

This is a lie, it was not a mistake by one of your new support agents.

Let me recap what happened.

  1. I deposited .090 BTC
  2. Gambled on live baccarat tables.
  3. I Successfully withdrew 2BTC.
  4. I deposited .50 BTC
  5. (Realized it wasn't enough to sit on a certain high limit baccarat table)
  6. So I deposited another .20 BTC
  7. Gambled on high limit live baccarat tables
  8. Tried to withdraw 4.5 BTC. 
  9. I deposited .25 BTC
  10. Gambled on high limit live baccarat tables
  11. I successfully withdraw 1 BTC

So that is 2 separate withdraws, and 4 separate deposits.
