Dear Katherine Jones,

As appointed spokesperson, answering to first and/previous email, I demand that your superior re-answers/confirms what you wrote back to me, with attachment "Affidavit_of_Identity_Mystake_email" included; printed, filled, signed and finally added in attachment which is my legal right to demand from you.
You, Katherine, being responsible for overseeing and managing this regulatory compliance issue will undoubtedly know as is indeed my right to demand from you.

I'm looking forward to your reply with the attachment filled and signed.
Salutations.

Post Scriptum: thank you for adding food for thoughts by people with more intellect than yours and mine.

The second part being mine to fill and handle for further judiciary steps.
Why; you clearly avoided giving a response which we expected as being sufficiently explanatory to my initial request made.
My interpretation is one of bouncing elements back to me which I already admitted, pointed out and answered.

More specific; I did indeed read your terms & conditions on date of registration which lies between actual registration and Mystake officially but more important PUBLICLY being mentioned in the illegal online gambling list.
This  moment on my timeline, I was in my right to notify Mystake and ask for reimbursements.
Certainly when other listed online websites belonging to the operator had previousely already been blacklisted, Rolletto even showing a correct landing page for people from restricted countries.
This shows not only that Mystake keeps registrations open when in fact should be blocked and Velobet showing malicious intent when considering their date of launch.

These are grave undeniable facts which show a criminal environment.
You may still and again refuse me my refund but know I am prepared to go the way, the only way which surprinsingely not even one duped person on any review site holds up as measure to be taken.
I won't foul myself on a, 1 review....which means nothing for the financial and regulatory avoiding entities running this charade.
This or even these entities, thus whatever tax- or law- avoiding reason may lay at the base, can be considered one and dealth with as one from any possible angle, beginning with all kinds of basic providers and ending with international cybercrime law or other anonymous-like fixes.

With kind regards,
Sincerely,
Jan Duchau

Hello,

It was shown to me that Mystake.com is listed as illegal gambling site for players originating and with residency in Belgium.

As Belgium is neither mentioned in the Terms and conditions nor in the Privacy Policy forwarded links from webpage mystake.com/en/registration where I had to tick 'I am over 18+ years, I accept Terms and conditions and Privacy Policy' + the fact that during my registration, then up to today, Belgium was/still is selectable under Country is, intentionally or not, misleading to open an account & deposit + play with the best of intentions following the law (BE Gaming commission) and Mystake.com's Terms & Conditions.
*personally i think intentionally if i look at all the facts I have in my posession, but I leave this to experts in the eventuality of a complaint being submitted.*

I like to direct your attention to point 3. WHO CAN PLAY:The Company accepts players only from those countries and geographic regions where online gambling is allowed by law. It is the player’s sole responsibility to inquire about the existing gambling laws and regulations of the given jurisdiction before placing bets on the website.

We accept strictly adult Players (the minimal age is 18) and Players who have reached the age specified by the jurisdiction of Player’s place of residence as eligible for online gaming. It is the Player’s sole responsibility to inquire about the existing laws and regulations of the given jurisdiction regarding age limitations for online gambling.

It is entirely and solely Your responsibility to enquire and ensure that You do not breach laws applicable to You by participating in the games. Depositing real funds and playing for real money is subject to the laws of Your country, and it is Your sole responsibility to abide by Your native regulations.

We shall be entitled to refuse bets from Players who fail to abide by these Terms and Conditions.

I am allowed to gamble everywhere except on an online gambling site that is illegal/blacklisted.

With this information in mind and following the pre-complaint steps to be taken by myself in contact with mystake.com I want a total refund of my 2 deposits, total amount being € 95, a closure of my account being confirmed via email from [email protected] ... after following details herefore mentioned came to light (this email from [email protected] to [email protected] on 06-02-2024) which restrict me from opening an account and mystake.com from letting me open one.

+ removing Belgium from the to selected country's as country of origin on the registration page & create a landing page like example
This is a personal request (tip) to maintain fairness and following regulatory ordonances.

Okay so, as per my own conversation with this casino they have stated the following when being asked do they accept players from Belgium,

coco, to be straightforward...I don't wish to use the AG  complaint service.

Personally I don't believe in it for matters such as these cause casino and group are sailing through holes, looting and pillaging along the way to worlds end.

I registered a couple of days into 2024 at this casino.

Deposied two times, which I checked fell into the 30 day window after registration to file a complaint (see date first emaill)

At that time they were apparently already blacklisted for players from Belgium.

I noticed this at the beginning of february and send them my first email, which you can read, addressing them about the situation accordingly.

So at the beginning of january they already knew via gamingcommission.be who emailed them at the beginning of october 2023 (date of publication in the Belgium government gazette) which I had confirmed.

This is my point; They did not install any stops, did not remove any Belgian entrances like country of origin or verify phonenmbr with +(32) prefilled + never change(d) their terms & conditions.

How could I know? I always read the t&c thoroughly and send my kyc docs within first hour after registration to be sure.

I deposited with bancontact through Mifinity, Bancontact only existing in Belgium for Belgian people: Bancontact Payconiq Company SA/NV
82, rue d’Arlon , 1040-Brussels, Belgium
www.bancontact.com
DPO: dpo(at)bancontact(dot)com

All this should not be possible technically if you follow the rules!

Hiding behind you accepted t&c, deposited funds can not be refunded when played ... BLAHBLAHBLAH... is waste because factually I should not be able to register/get verified/deposit !!!

Terms and conditions only cover you so far to the point where had I known I would never hurt myself by deposting there, de facto burnig cash money which is a crime.

This is something few people know but courts have already judged following this principle in many countries in favour of players.

So they already had a huge fine hanging above their heads from Rolletto two years earlier, but due 2 the different operator setup was hard to multiply I guess since they received first & second degree fines only in 2023 for both Mystake's (third for Goldenbet)

Goldenbet was listed as illegal in the month of november and additional dossiers are being looked at, nothing official at time of contact.

What and how this works I have no official confirmation but from what I figured out they get a fine, through international notary channel(s) served, but I highly doubt anyone pays these.

The big underline is that the person responsible gets flagged in Belgium for sure, but all other countries which blacklisted them aswell.

If he gets spotted in one of these countries, he gets arrested and must pay before leaving jail, or country is possible.

If this is a close member of the EU, like France, they will demand extended consequences and paypents in accordance / on behalf of their fellow EU neighbour(s) at least.

So, like you might know or not, Austria at the moment is writing some basis for global regulatory law, which the EU can launch at U.N. or G-8 summit I presume.

When and how this gets aired and picked up is a question mark but it is important we keep pushing and putting in our coplaints everywhere.

They maybe won't budge immediately or get mediatised but in future they really can and I personally know for sure this will read as fresh, piping hot pastry served on sundayafternoon.
