Hi,

 

Today i saw a topic/complaint that got my interest. A casino won't pay a customer his winnings because a breach in bonus terms.

The customer never accepted the bonus terms because he is playing on his iphone and simply doesn't have an option to accept the bonus terms.

The casino says that the bonus terms are on the website and the customer accepted the terms in that way.

 

I am curious what other players think about this case? I am also wondering how many players have there own experience with bogus bonus terms hiding in difficult and long bonus terms?

When you say the customer never accepted the bonus terms what exactly do you mean by this? If when taking a bonus you have to first accept it's terms then you can't have the bonus until you accept them. Or if the bonus was automatic with your deposit, the player would have known that that bonus comes with terms. So by playing the bonus he accepts the terms.

 

So my opinion on this, from the facts you have given is that the player doesn't really stand a chance. Regardless of whether or not you are playing on your phone or your desktop we all know when playing with a bonus it has terms attached.

I have an adroid phone and the web browser could be changed into desktop version if you want to so you will be able to view them.

Accepting their bonuses is automatically accepting their terms. It is your responsibility to read them whether you could or couldn't.

Nothing to add to the advice given at the above posts... 

 

Maybe would only like to mention that not bothering to read carefully all casino and bonus terms is a sure recipe for a disaster afterwards! I've seen thousands of online players losing their winnings due to violation of one or another casino/bonus term only because they never read that before registering at the casino and/or playing with a bonus there.

The terms and conditions on which the parties are contracting must be agreed by both parties and incorporated into the contract between them. Simply placing terms and conditions on a website is not enough to incorporate them into a contract: the parties must agree that they contract on the stated terms, and they must do so before (or at the same time as) becoming contractually bound. When dealing with customers of a website the seller must ensure that the ordering process requires the customers to read and agree to the seller's terms and conditions.

 

I think its a generalisation to think that everybody knows that playing with a bonus automaticly comes with terms. My own experience is that terms tend to varied from casino to casino. For example ive been playing now for 5 years in online casino's. Last week i tried to withdrawl some 700 euro's from casino cruise. I got my money confiscated because of breaching the bonus terms. I made to high bets when using a bonus together with my deposit. For me it was the first time this happened. 

 

I also have a few problems with this.

 

1. I have never seen any proof of my suposidly misconduct.

 

2. Sure u have ure wagering requirements, i think everybody understands when getting a bonus its not aloud to withdraw it straight away.But I think Its unreasonable to expect people who want to have a good time to read a multiple page document with language only a lawyer can understand.

 

 

4. It is totaly unclear for me at which point i am using bonus money or my own money. I made three deposits in that session plus deposit and bonus go into one account.  Why does a casino not simply turn of the bets that are not aloud? No they wait until i lose my money and if i win they confiscate and therefore give the casino another edge on top of an already big edge a casino naturally has.

 

5. Free spins and bonus money in this way become a liability. Take 5 free spins and if  i dont watch out i get my money confiscated because of a breach in bonus terms.

 

On top of this i think it doesn't create much trust in online casino's. A win is a win and losing is losing in my opinion. I dont want to end up in some legal battle if i might be lucky enough to win something. I ended my account with casino cruise because i lost my trust and just want to have a nice time.

Some casinos have an auto warning messages  on a certain games regarding playing with their bonus money and some don't but still the terms are there.

If you have problem with undestanding (or don't trust) the terms and whatnot it's probably best you do not use their bonuses to make your play a bit simpler. Keep in mind, using their bonuses is the same as using their money to play and there are certain rules attached to it.

I have viewed the complain and seems to me that Casino Cruise explained the issue to the player clearly. Since it's about a great amount of money it's hard to accept your loss.

Next time take the time to read the terms.

5 years and you never knew there was a max bet rule when playing with a bonus? The terms associated with most bonuses these days will always state a max bet rule.

I agree with Coco. But I have to say that the things you said seemed a little odd if you've been a gambler for 5 years now..I think the easiest solution is to not play with bonuses, when you want to place big bets (such as 10€ per spin for example). I have been gambling for a few years now and I have never had confiscated winnings due to breach of terms, I always ask support all my questions dozens of times, as well as read everything, especially when I am playing with a bonus because often times there are games that cannot be played with bonuses. Definitely read the guide VaIDes posted here, you will find all the info you need. You know, at the end the more careful you are and introduce yourself with terms at each casino, the less possibility you will have your winnings void, so only few minutes while reading terms will help you to stay out of trouble! :)

You'v raised such a good point there Blondie! Neither have I ever had money confiscated due to breach of bonus terms and it's because as you mentioned we make sure we ask ALL the questions we need to before playing!

With all the bonus issues,never took bonuses when I just wanted to have a bit of fun (mostly betting on football)...but since my gambling strategy has changed from just having fun, nowadays I read the whole T&C more than twice, after all experienced lawyers write those stuff!

I don't really understand. Was he denied the payout because he never checked the terms and condition box? Or because he made a breach of t&a he wasn't aware he made? If it is the former, the acceptance of the bonus should be a tacit acceptance of the terms, regardless of whether the iphone version makes a pop-up or not. If the terms had been denied, he wouldn't have been alloted the bonus.... Right?

Correct Princess, you can't have a bonus unless you agree to the terms. You don't always have to tick a box to say you accept the bonus terms, but by clicking the box when you first register this bounds you to their terms anyway.

I guess reading the actual complaint would answer all your questions. :) It turned out to be way different than what player initially claimed to be...
